ciao, visti gli ultimi sviluppi relativi alla licenza (o mancanza di sviluppi nella stessa) penso di scrivere la seguente al consiglio di amministrazione della Fondazione. Molti mi hanno scritto, sollevando le loro singole personali preoccupazioni. Ho già sentito Edoardo in privato.
(italiano in fondo al messaggio) -------------------------------- Dear Andy Robinson secretary of the OpenStreetMap Foundation, and dear all the board and board-at-large/team of OSMF, We are writing on behalf of many Italian contributors to openstreetmap, they are concerned about the lack of information on the new license, which is is said will be revealed by the Foundation in the coming weeks. Since this is a fundamental change in the relationship between the contributors and the Project, we believe that the license that has been drafted by the legal team should be submitted to the same userbase so they can analyze it carefully and highlight any problems that might have not been considered by the team itself. Furthermore, under Italian law, a non-translated licence, one that is not translated into the language of the Country is not valid and it may subsequently be challenged in court at any time. In recent months, the silence that has accompanied the license has given rise to many doubts. The license is a fundamental stone of the project and we wish not to hurry to come to a conclusion, and lose sight of its true purpose. Which is to help OSM grow better in the future. We ask you then to make the draft public now, as of the latest revision, so that it can be translated at least in the major languages (please note that in many European legislations only a contract signed in a language known to the person signing it has a legal status), at least French, German and Spanish. Then Italian, Chinese, Russian and Indian. Trattandosi di una modifica fondamentale nel rapporto tra i contributori ed il progetto, riteniamo che la licenza che è stata elaborata dal team legale vada presentata alla platea degli stessi in modo che possano analizzarla con attenzione ed evidenziare eventuali problemi che potrebbero essere sfuggiti al team stesso. inoltre secondo la legge italiana, una licenza non tradotta nella lingua ufficiale del Paese non è valida ed essa può essere impugnata successivamente in un qualunque momento. Il silenzio che negli ultimi mesi ha accompagnato la licenza ha dato adito a molti dubbi. La licenza è un pezzo fondamentale del progetto e non vorremmo che per la fretta di arrivare alla conclusione della transizione si perda di vista il suo vero scopo. Vi chiediamo quindi di rendere pubblica l'ultima bozza elaborata della licenza stessa, in modo che questa possa essere tradotta quanto meno nelle lingue principali (facciamo presente che in molte legislazioni europee un contratto sottoscritto esclusivamente in una lingua diversa da quella del cedente non ha valore), quanto meno francese, tedesco e spagnolo. A seguire Italiano, Cinese, Russo ed Indiano A questa pubblicazione chiediamo che si consenta alla discussione al riguardo nelle mailing list nazionali per almeno un mese al termine del quale le osservazioni vengano raccolte ed analizzate per un'ulteriore stesura della licenza. Una fondazione come OSM dovrebbe esser un esempio di trasparenza e invece appare ultimamento come se voglia tenere nascosto fino all'ultimo secondo qualsiasi cosa.
