For a recipent this is not an issue.  For a single business/organization
it's not an issue.  For an ISP who lets his accounts decide for themselves
what goes into their spools, it's not an issue.

For an ISP who filters on the MTA side rejecting email based on *his*
site-wide preferences, it's a potential problem.  If the ISP is selling
something to his customers, and if a spammer is trying to sell the
same thing to those customers, and if the ISP prevents the spammer's
advertising from reaching their targets, it could be construed as
an anti-competitive practice.

Whether the spammer could win is academic.  The cost of defending against
a suit in US federal court is very high.
