T-Online obviously treats everyone as a service provider ("Diensteanbieter"). And "Diensteanbieter" must comply with EU-Richtlinie 2000/31/EG Artikel 5 where it's said: Artikel 5 Allgemeine Informationspflichten (1) Zusätzlich zu den sonstigen Informationsanforderungen nach dem Gemeinschaftsrecht stellen die Mitgliedstaaten sicher, daß der Diensteanbieter den Nutzern des Dienstes und den zuständigen Behörden zumindest die nachstehend aufgeführten Informationen leicht, unmittelbar und ständig verfügbar macht: a) den Namen des Diensteanbieters; b) die geographische Anschrift, unter der der Diensteanbieter niedergelassen ist; ... Do you see a way to provide the service providers name, snail mail address, Handelsregisternummer in an _easy_ way ("leicht ... verfügbar"), using a SMTP Server? Putting these informations in the SMTP handshake (i.e. HELP command) is for sure _not_ seen as an easy way by EU bureaucrats or lawyers. On the other hand, setting up a minimalistic webserver with just one static page, no php, no cgi or stuff, is some tedious extra work but not a big safety risk.
