The last time I checked, the ICANN registrar contracts require any registrar to send domain confirmation messages to registrants. If the registants don't accept them, they don't get to stop. To look at it another way, if Tucows had looked at the 5xx, stopped sending you mail, and you lost the domain anyway, I don't think you would have been any happier.
