You still need to go back and read rule 13 until you understand it. The colregs are deliberately vague and some rules supercede others depending on situation. Your quote is only correct in very basic terms. A fishing boat with a net dragging behind does not have complete immunity to the colregs in all situations. In admiralty court, all parties will be assigned some portion of the blame for any collision. It is almost unheard of for any captain in a collision to come out without being assigned any percentage of the blame. If you are properly anchored in a designated anchorage, and are asleep in your bunk when a drunk plows into your boat at 2:30 am, you will be held partly responsible because you will be found to have violated some colregs. I Guarantee it. In this case as described, the fishing vessel was overtaking, which give it responsibility to stay clear. That supercedes their position in the pecking order in a crossing situation. Rule 13 and Rule 2 are in play here.

Colregs depend on everyone knowing and doing what is expected, but allows for those who don't. A stand on vessel that gives way is screwing up the system. Being unpredictable is not what a licensed captain ever wants to be. Many on this list have had licenses at levels from 6-pack up to 100 ton Masters for years and decades. :-)
