Bill Bina is quite correct about doing what the regulations expect of you. That applies to the point where you become "in extremis". That point must be determined by the Master of the stand on vessel at the time and is always subject to review and judgement by the courts in cases where collisions result. Once "in extremis" it is the Master's obligation to take all possible actions to avoid collision. Or, as I put it earlier, to "get the hell out of the way". A prudent Captain has been on the VHF radio and sounding the ship's horn long before "in extremis" is declared in an effort to get the give way vessel to meet her obligation of keeping clear. I, for one, am all in favor of declaring "in extremis" sooner than later and giving yourself a better chance of avoiding collision. I have used the VHF radio to declare "in extremis" while announcing my rudder is full port or starboard. At the same the ship's horn is sounding the 5 blast danger signal danger signal followed shortly after by the appropriate signal for my turn direction. Sound signals and VHF broadcasts are continuous until the danger has passed. I have done this many times from the bridge of my trawler, as Officer of the Deck and as Commanding Officer of United States Navy Destroyers. I have never had a collision at sea and my judgement has never been called into question, post incident. Even with early action, I have had closer calls with vessels failing in their keep clear obligations than I might have wished. I have always reported such incidents to appropriate authorities whether in inland waters or on the high seas.
