Completely irrelevant. the legality or illegality of a specific spam message is 
not relevant to anyone unless that person is tasked with enforcing some 
anti-spam law.

The simple fact is, the vast majority of spam is completely unconcerned with 
laws, is by design untrackable, and all the legislation in the world will do 
*nothing* to curtail it.

This is why it is incumbent on us, as sysadmins, to deal with the problem as 
best we can. Until there is some law saying I cannot block spam, I will block 
as much as I can. If if I am ever forbidden from blocking it, I will simply 
shut down SMTP services completely.

80-95% of the connection attempts to port 25 are either rejected out of hand, 
or are spam that is tagged by SA. Somedays the percentage creeps very close to 
100%. The total percentage over the last 90 days is 83%.
