That's explicit.  "We the power company will explicitly offer you a discount, 
if you agree to let us cut your power occasionally."

And it's different from "We sell you a service with variable performance, 
that's not clearly defined, and today when you subscribe, all the averages are 
great and everything is fine, but we're going to continue provisioning higher 
priority customers and consequently lowering your relative prioritization over 
time, until that service becomes unreliable and sometimes unusable."
