How is the habeas marks people going to be in forced and make it work without being over run? There are so many spammers in many different countries. I have not seen one message that would have been a FP without habeas mark. They need to get there lawyers working. I consider the habeas mark has failed and is a waste of money.

Give it time... this attack (likely from one or a few spammers) has been going on for roughly 48 hours, that's all. Do you really expect that a spammer could be tracked down, a summons could be served, a civil trial could be convened, and a juudgement rendered in that ammount of time?

Once they get to the spammer (eventually someone will determine the origin of the emails for the zombie attacks) or bring legal action against the domains being spamvertised, they'll be able to sue the pants off of them. If past copyright suits (think RIAA) are an indication, I wouldn't be surprised if the penalties were some dollar ammount per violation. In other words, if a judge finds that Alan A. Spammer owes Habeas $1 per copyright violation, and Mr. Spammer has sent out 10 million emails... well, you get the picture.

As for FP prevention, you apparantly don't happen to correspond with many people who (legitmatelly) use Habeas. So what does that matter to you? More important than whitelisting legit senders, IMHO, is Habeas' ability to put some serious financial hurt on spammers.

Be patient. Use additional rules/tools to catch the latest spammers (clue: most come from spam zombie processes). Report the Habeas violators (more $$$ out of the spammers pockets!). Let's keep the Habeas marks as a tempting target for the spammers (strong negative score), so that they keep chomping at the bait.
