Point the first: There are many, many other filtering products in use in the real world which aren't as good as SpamAssassin. Just because SA wouldn't rate a particular legitimate message as spam is by no means a guarantee it would successfully pass through other systems. Many of those systems do recognize the Habeas SWE, however. Point the second: Like it or not, there are a whole range of marketers out there who employ e-mail in a legitimate (ie, completely verifiably solicited) way, but who's marketing materials or newsletters or what have you will trigger false positives even with SA. Those of us at the technical end of things often forget (or don't know) what it's like to be at the sales or marketing end of things, where even a product as good as SpamAssassin can be next to useless because the vast majority of legitimate business-related e-mail received bears many of the same characteristics as spam! The whole purpose of the Habeas SWE(tm) is to provide an enforceable guarantee of non-spaminess, like a BBB or Good Housekeeping seal of approval which allows legitimate mail which may appear spam-like to pass through filtering systems which would otherwise block them. If you encounter one shady business with a forged BBB certificate on the wall, does that mean you'll never trust the BBB again?
