Hummm... I wonder why I bother to get property releases then? 

You must not live in the US. Here you can sue anybody for
anything, you may not win, but you can file the suit and have
your day in court. 
There is a book titled "The Law and the Photographer". Anyone
who wants to know the right of this argument (one that is ended
with this post as far as I am concerned) ought to read it.
