I think that may be due to the shortsightedness of the Framers of the Constitution. They couldn't possibly have forseen every cultural advance. Other countries have their own forms of discrimination derived from their laws and formed from their biases, though, and the U.S. should hardly be singled out on these terms -- it only gets the most credit.
