Yeah, if the project were collaborative, and he requested the advice,
then it would be the consultants' job to make him aware of possible
snags.

I think that's one of those "forseeable future" kinds of things.  If
there's no short-term gain, then they might not be interested.

Not that I want to grasp at straws here... but a lot of universities
have rules about outside consulting... and if there were a
bureaucratic problem with that, then a university might offer 
funding of its own to maintain the project, and, of course, the
institution benefits.

Abuse of the patent system and inefficiencies of software patents
notwithstanding, the idea that any single person can prescribe what
the finished product will be.
