Most monopolies are awarded with a condition that all changes in prices, terms, etc are subject to some kind of approval.
E.g., here in Wisconsin all our public utilities - monopolies - must get approval from the Citizen's Utility Board for any rate change. I would imagine it's something similar in most all the states. Except for what X12/DISA got from the Federal Government... that took 535 members of Congress most of whom cannot spell "EDI" to vote "YES" without understanding the result of said vote. The way the bill was adopted (as a conference report) mandated the use of the 005010 standard and the implementations as proposed by X12N. For some reason they did not put "HIPAA II" through the NPRM process like they did HIPAA I. (NPRM= Notice of Proposed Rulemaking: solicits public response prior to final adoption and publication as law). NPRM worked real nice for HIPAA I and would have worked just fine for HIPAA II IMO. I don't often say nice things about liberals, but then-HHS-secretary Donna Shalala did a real nice job rolling out HIPPA I. HIPAA II was just a goldmine for DISA and for all the software and consulting firms specializing in "Healthcare EDI." Ironically enough, this "improvement" will accomplish little beyond raising the price of healthcare to cover all the software upgrades required. Call it "Obamacare I" if you like, although not quite in the same 'increased costs' league with the ACA (what normal people (normal= non EDI geeks) refer to as Obamacare). Michael C.
