Let's say you get a gig from Comcast. And you have a server farm. So you use a tunnel to connect your server farm to a college campus internal network. Now all of the students can obtain the content on your servers. I don't think anyone would consider that reselling. Even if the college or the students are paying a fee for the content.

Now, let's say the college lets you use their DIA and a bunch of IPs to use. Nice guys.

And then on your end allowing others to use that DIA and those IPs....
Obviously reselling connectivity to the campus DIA but not Comcast.

I would think in this scenario, that as long as you are not passing external customer IP traffic over the layer 3 Comcast network for them to route and forward you are not reselling their services. After thinking about it a bit, I think a tunnel can be used for whatever you want. Be very hard to define things that are OK to tunnel and not OK. Maybe a focus could be, are you taking customers that would otherwise be Comcast customers? In that case the answer is probably not ok and would be considered reselling.

Not sure how I would word an AUP if I was Comcast in this situation. You can't tell the customer they cannot make money off their connection or their tunnel. Let's say you have a video subscription service on your server farm. That could compete with the Comcast video business. Would I, as Comcast, try to limit all competitive uses in the AUP? Perhaps...

Interesting question. Since I am just now starting to hook up customers to my new company, I may have to consider this in an AUP. Plain language. If you are doing something that can be considered competing with me, that is ungood and you will have to take a timeout. I wonder how that will play with my new customers?

Obviously getting a connection and sticking customers on the provider’s IP addresses would be reselling without a doubt.

Is running a tunnel over a circuit back to a data center and sticking customer traffic in the tunnel reselling? I would think not as the only thing the connection is carrying is my VPN traffic.

So now further down the rabbit hole - if the provider supports BGP and I’m using my IP addresses - am I “reselling” the provider’s service or mine?
