Why in the world would this be illegal?? I could understand MS having an
interest in not having people do it, if they offer for sale something that
has similar functionality. Maybe they even put something into XP to break
vnc for this reason, which would be rotten but not inconceivable. But
illegal? On what basis?

Or was this an attempt at humor?
