dan, there is no change we can make to grub to prevent this from happening if grub-pc/install_devices is not set correctly. Unless you can show that the installer does not set it correctly, then there is nothing we can do.
Cian, did you ever have an issue with grub before ( possibly when you first installed 13.10 ) and fix it by using boot-repair or otherwise? If you run debconf-show grub-pc, you should see the grub- pc/install_devices setting. That variable must point to your boot drive for grub to be upgraded properly.
