Have you tried this?  I have and AT&T "caught" me after about a month and told 
me that they require dataplans on ALL smartphones - whether they were purchased 
from AT&T or not (they told me that if I wanted to stop the dataplan, they 
would block my usage of that phone).  They claim that all of the cell phone 
companies now have that policy.  So far this has been true on 2 iPhone 3's - 
however, they seem to allow me to use our older (non-3G) iphone's without 
insisting on a dataplan.


Yes, I have been using Android phones on the Roger network in Canada with
normal voice plans for nearly two years.

Did you check what your contract says? Even if it is in the contract, I wonder
how legal this is. Are there other GSM providers in the US?

Yes - according to their "Wireless Customer Agreement" it is required.  Here's

I believe T-Mobile is the only other GSM provider in the US, but I don't know
