I meant the generic kernels that Ubuntu provides (2.6.31-32) are the issue. I did not try to download and compile a kernel provided by Ubuntu. Instead I downloaded the 2.6.33.3 Stable kernel from http://kernel.org/ . I used the same .config file from the previous kernel but turned on some logging f

Okay, so I think I have found the issue. It has nothing to do with the ath9k drivers, it appear to have everything to do with the stock kernel that came with my Linux distro.
