I don't like this clause; it seems to me that the inability to decide with certainty the legality of an actual past game action is exactly what wins by paradox are supposed to be for, at least in Suber's formulation. Also, completely unrelated to the substance of the proposal, I'm fairly certain you misspelled "occurred" and "occurring", unless this is a case of Brits not doubling (doublling?) a consonant when Americans do, instead of the usual other way around.
