I would prefer REMAND. There's no reason the original judge couldn't
improve eir judgement given the subsequent admission by the defendant.
This is not the first time I've seen a judgement along the lines of
"undecided because I didn't bother to so much as ask an obvious
question". Still, I suppose the proto is statement enough; I
pre-emptively consent to you causing the panel to judge REMAND.
