Perhaps the philosophical issues of the "other OS's" (i.e. Linux) are more significant than the actual licensing issues. Many/most Linux users could legally use a native optimized kernel implementation of Sun ZFS if it was offered to them to do so. GPLv2 only adds restrictions when copying binaries. A pure source based distribution like Gentoo has hardly any issues at all.
