In the US, that would likely fall under the Magnuson-Moss Warranty Act
and a breach of implied warranty. They are actually quite powerful for
folks who know how to use them, like lawyers practicing in consumer
protection.

Imagine if Subway tried to disclaim warranty by stating their
sandwiches were not fit for human consumption (in fine print and low
contrast font). The implied warranty ensures it is possible for a
consumer who gets food poisoning to state a claim. Also see
