I did Competency evaluations for two years; not sure what the specific law is in NJ(?), but in CA the critical question is not does the defendant have dementia or psychosis, but can they cooperate meaningfully in their defense. Malingering of course is a constant problem. In my experience a person charged with murder and claiming to be incompetent to stand trial would be held in a state psychiatric hospital for continuous observation, treatment, education and evaluation, though I believe there are cases where wealthy people could go to a private facility (previously betted and approved by the state for the purpose). It seems very unusual to me that such a person could stay at home while being evaluated and treated; then again, this does seem to be NJ and it does sound like it was taken from a David Chase plot.
