There is nothing technically 'magical' about the Habeas headers. They could simply be faked. Habeas Corp says that they make use of copyright laws to pursue legal action against spammers

but many spammers hide behind abused relays and foreign ISP's beyond the reach of local laws. Am I missing something about the ability of 'Habeas' Corp to find and sue spammers?
See http://habeas.com/supportFAQs.html item 4.4: "What about spammers operating internationally?" The gist is that international copyright treaties cover most of the world, and any US-based company can still be held liable under US laws even if they're relaying through another country.
Additionally, Habeas can blacklist those using the mark without authorization. (Tricky if they're using open proxies, but it does add some more teeth.)

Now this is kinda stupid. If the whole 'point' of Habeas is that the headers include a copyrighted work of art (the haiku) then failing to test for the lines containing that work of art would allow spammers to only fake the one header that we test for, which does not contain that art.....
Well, it does contain 33% of that art...
I agree, though: it makes more sense to test for at least the entire haiku, if not the full nine lines with attribution. It may not be what they meant, but I'd interpret this as saying you should only *need* to test for the one line.
