In that case, prosecute him for incitement.

There are no freedoms without limits. With freedom of speech, that
freedom is circumscribed by the effects of that speech. You are
responsible for the effects of your speech. So if your speech incites
hatred or brings individuals into disrepute, you are going to have to
bear the consequences for it.

The important thing is that the only valid way to make the judgement
(IMO) is by the effects. Banning speech is a bad precedent.
