My wifi driver is iwl3945, so I had to use something different, than you have
suggested, but it got me started on the right path:
If you have a iwl3945 wifi chip, you can try it on a fly:
sudo modprobe -r iwl3945
sudo modprobe iwl3945 disable_hw_scan=0

Just wanted to check in with some new info. I'd read some indications
online that this isn't universal with all Intel wi-fi chipsets.

Same problem here too.
I can confirm, that going back to Kernel 2.6.38-8.42 doesn't have this issue -
just like Jan mentioned it in the bug report.
Interestingly enough it happens to me on an HP laptop too.

Same problem. Network with wifi very slow after upgrade kernel to 2.6.38-10
This problem don't occur with kernel 2.6.38-8. Unfortunately i remove old
kernel. Now i use lan, because wifi it's paintful.
