My biggest things are the use of the logo WITH the title of Flex Presentation. It recommends endorsement, which is clearly not the case. If he removes our logo as his icon (and any other placement of it, or Apache logos), then I would say it is generic enough to not warrant any additional modific

No need IMO to get trademarks involved just a polite email for right trademark and perhaps link to site. Assuming they are using Apache Flex rather than Adobe Flex that is.
