I did but the best proof that the device is free is that gxine -A oss
test.ac3 works fine. and oss uses the device for itself as far as I know.

follow i'm wondering if there is anything like a networked Jack / ALSA
'something' that enables to make Synth / DSP / Recording 'nodes' and
automaticly deals with latency just like FM-MAX T

I have an ALC880 card (snd_hda_intel) with the digital out connected to
an external amplifier. and have a clean ubuntu dapper installation
The sound works fine for whatever stereo sources ogg, mp3 but as soon as
I try to listen to ac3 passthrough then I get a device busy error
for example :
