The court also slapped a 3,000 euro fine on Micheline Beuzit, an employee who told a Senegalese-born job seeker "the Moulin Rouge doesn't take blacks in the theatre, only in the kitchen". An investigation by state prosecutors found the Moulin Rouge, whose scantily-clad can-can dancers are a huge tourist draw, had not hired a coloured person as a performer or waiter for 40 years, although many are employed as kitchen staff. Abdoulaye Marega, who was turned away when he applied for the job in January 2001, was awarded 4,500 euros in damages. French anti-racism group SOS Racisme, which helped Marega bring the case, was awarded 2,300 euros. Mr Marega says the judgment "showed that France, a country of human rights, was not a racist country". The relentlessly self-promoting CEO of Oracle Corp., a Silicon Valley software company famous for its ability to grab government contracts, envisions post-September 11 America as a country where everyone walks around with a "smart card." Days after the terrorist attacks, the opportunistic Ellison was all over the media claiming that "We need a national ID card with our photograph and thumbprint digitized and embedded in the ID card." Naturally, it would all be backed up by an Oracle database. And, of course, he will do it for free at least until the first inevitable "upgrade." The only way to protect ourselves from terrorists is to "ensure that all the information in myriad government databases was integrated into a single national file," says Ellison. Oh, and we should not worry about the government intruding where it is not supposed to, because privacy is so pre-September 11: "Well, this privacy you're concerned about is largely an illusion," Ellison told news anchor Hank Plante of San Francisco's KPIX-TV shortly after September 11. "All you have to give up is your illusions, not any of your privacy. Right now, you can go onto the Internet and get a credit report about your neighbor and find out where your neighbor works, how much they [sic] earn and if they [sic] had a late mortgage payment and tons of other information." We are all serfs now, anyway, so why not wear the slave collar and be done with it? It is an interesting argument to make, and oddly compelling but not to real Americans, who never were serfs and never will be. We have been so busy worrying about Big Brother snooping, says Ellison, that "we've made it impossible for the government to protect us." Besides, all this anxiety about such archaic abstractions as "liberty" and "privacy" is rather dated. We, on the other hand, live in a age of yuppies and demagogues, when such old-fashioned niceties as individual liberty and the right to be left alone have long since ceased to exist. With agencies finally willing to act, it's feeding time for companies. At the public trough, many snouts compete for a larger share of the swill: In the four months since the attacks, dozens of technology companies have tried to sell themselves as the answer to the government's security prayers. Suddenly, projects like a multi-million dollar database integration effort for the entire federal law enforcement community, explosive detection equipment for luggage screening at every U.S. airport and new surveillance technologies for the domestic war on terrorism are all possible, and they're all business. In the wake of the terrorist attacks, many Americans turned to religion for consolation. Our governing elites, however, turned to technology or, rather, to a faith in technology that approximates religion. Their faith, however, may be shaken by the first major "software glitch" in the system: They fail to recognize that software is no substitute for the kind of human intelligence that our law-enforcement agencies so lack. If what Colleen Rowley says is true if, indeed, top FBI officials obstructed the pre-September 11 antiterrorism investigation then a "database integration effort" is irrelevant. A war that can't be won The west isn't just losing the fight against terrorism - it is fueling it across the globe Seumas Milne Thursday November 21, 2002 The Guardian This time last year, supporters of George Bush's war on terror were in euphoric mood. As one Taliban stronghold after another fell to the US-backed Northern Alliance, they hailed the advance as a decisive blow to the authors of the September 11 atrocities. The critics and doom-mongers had been confounded, cheerleaders crowed. Kites were flying again, music was playing and women were throwing off their burkas with joyful abandon. As the US president demanded Osama bin Laden "dead or alive", government officials on both sides of the Atlantic whispered that they were less than 48 hours from laying hands on the al-Qaida leader. By destroying the terrorist network's Afghan bases and its Taliban sponsors, supporters of the war argued, the Americans and their friends had ripped the heart out of the beast. Washington would now begin to address Muslim and Arab grievances by fast-tracking the establishment of a Palestinian state. Downing Street even published a rollcall of shame of journalists they claimed had been proved wrong by a hundred days of triumph. And in parliament, Jack Straw ridiculed Labour MPs for suggesting that the US and Britain might still be fighting in Afghanistan 12 months down the line. One year on, the crowing has long since faded away; reality has sunk in. After six months of multiplying Islamist attacks on US, Australian and European targets, civilian and military - in Tunisia, Pakistan, Kuwait, Russia, Jordan, Yemen, the US and Indonesia - western politicians are having to face the fact that they are losing their war on terror. In Britain, the prime minister has taken to warning of the "painful price" that the country will have to pay to defeat those who are "inimical to all we stand for", while leaks about the risk of chemical or biological attacks have become ever more lurid. After a year of US military operations in Afghanistan and around the world, the CIA director George Tenet had to concede that the threat from al-Qaida and associated jihadist groups was as serious as before September 11. "They've reconstituted, they are coming after us," he said. In other words, the global US onslaught had been a complete failure - at least as far as dealing with non-state terrorism was concerned. Tom Daschle, the Democrats' leader in the Senate, was even more brutal. Summing up a litany of unmet objectives in the US confrontation with militant Islamism, he asked: "By what measure can we say this has been successful?" But most galling of all has been the authentication of the latest taped message from Bin Laden himself, promising bloody revenge for the deaths of the innocent in Palestine, Iraq and Afghanistan. This was the man whose capture or killing was, after all, the first objective of Bush's war. And yet, along with the Taliban leader and one-eyed motorbiker Mullah Omar, the mastermind of America's humiliation remains free. Meanwhile, in Afghanistan itself, the record is just as dismal. By using the heroin-financed gangsters of the Northern Alliance to overthrow the Taliban regime and pursue al-Qaida remnants ever since, the US has handed over most of the country to the same war criminals who devastated Afghanistan in the early 1990s. In Kabul, the US puppet president Hamid Karzai can rely on foreign troops to prop up his fragile authority. There, and in a few other urban centres, some girls' schools have re-opened and the worst manifestations of the Taliban's grotesque oppression of women have gone. But in much of what is once again the opium capital of the world, the return of the lawlords has meant harsh political repression, lawlessness, mass rape and widespread torture, the bombing or closure of schools, as well as Taliban-style policing of women's dress and behaviour. The systematic use by Ismail Khan, who runs much of western Afghanistan with US support, of electric shock torture, arbitrary arrests and whippings to crush dissent is set out in a new Human Rights Watch report. Khan was nevertheless described by the US defence secretary Donald Rumsfeld recently as a "thoughtful" and "appealing" person. His counterpart in the north, General Dostam, has in turn just been accused by the UN of torturing witnesses to his troops' murder of thousands of Taliban prisoners late last year, when he was working closely with US special forces. The death toll exacted for this "liberation" can only be estimated. But a consensus is growing that around 3,500 Afghan civilians were killed by US bombing (which included the large-scale use of depleted uranium weapons), with up to 10,000 combatants killed and many more deaths from cold and hunger as a result of the military action. War in Iraq: What's at Stake for Russia? Summary Russia might be too internally fragile to survive a U.S.-led war against Iraq without sliding into a deep crisis. At best, Moscow will be weakened economically, politically and internationally; at worst, the nation could suffer economic collapse and internal instability that severs its status as a U.S. ally. Analysis This piece, the first in Stratfor's "Iraq War Stakes" series, examines what is at stake for Russia in a U.S.-led war against Iraq. Such a war probably would affect Russia more than any other world power, with implications that could have a profound impact on the post-bellum world order. Prospects for Economic Collapse Russia has much to lose and little to gain in the event of a U.S.-led war against Iraq. For Moscow, virtually everything is at stake: the nation's economic health, internal stability and international standing and influence. Oil is the blood of world economy, and this blood likely would turn bad for Russia in the event of war. During the course of military action, global oil prices would jump sharply and then enter a deep and prolonged spiral, should the United States win the war and establish control over the Iraqi oil industry -- which likely would mean soaring production levels. On the surface, it would appear that Russia, a major oil exporter, would benefit during the war and suffer afterward, but in reality the nation likely would suffer both during and after the conflict. Russian oil production is already at maximum levels, meaning that domestic energy companies would not be able to boost production significantly enough to take advantage of higher prices. In order to benefit from a temporary wartime price hike, they would have to increase exports by diminishing sales to Russian customers. Moreover, the prices of Russian gasoline and other refined products would skyrocket with the increased global price. Therefore, the country could face both an internal supply shortage and cosmic energy prices that would shut many Russian citizens and businesses out of the market. We should not forget that the Russian economy is correctly dubbed a "wild market" in which everything is for sale for a profit. Moscow's attempts to intervene in the market probably would fail: The country does not have strategic petroleum reserves, an idea which is only in the early stages of discussion. Needless to say, an energy supply shortage or prohibitive prices, or both, would severely hurt industry and citizens alike. Vast, distant regions such as Siberia and the Russian Far East, which already have experienced energy shortages for several consecutive years, would be hardest-hit, possibly leading to the collapse of regional economies and businesses. However, the national economy as a whole would continue to limp along. Should a war in Iraq continue for several months, however, the concomitant supply shortages and high domestic gasoline prices could knock the crutches out from under even the national economy. Even the more probable scenario of a fairly rapid U.S. victory will not allow Moscow to breathe easily. U.S. control over the Iraqi oil industry would be a likely, if unintended, consequence of military victory and would lead to much higher production levels from Iraq. This is integral to Washington's strategic interest: decreasing global oil prices to levels that would allow a sustained U.S. economic recovery. During his Nov. 22 visit to Russia, U.S. President George W. Bush said Washington would protect Russia's economic interests in Iraq, although Foreign Ministry sources say he did not elaborate or give any guarantees. To protect Russian oil interests, Washington would have to agree that Iraq's richest fields would remain under Moscow's control following the overthrow of Hussein, and it would have to block the expansion of U.S. energy majors into the country. It is important to note, however, that there is more at stake in Iraq than Russia's oil concessions -- its oil-dependent economy also would suffer, and Washington cannot protect Moscow from the consequences of a price decline. According to the Hong Kong-based Asia Times, some U.S. State Department officials say Washington is seeking a crude price of $13 per barrel. Mikhail Khodorkovsky, the head of Russian energy giant Yukos, predicts that oil prices following an Iraq war would be $14-$16 in the best-case scenario for Russia, $12-$14 in the worst. Washington's oil price strategy is distinctly at odds with that of Moscow, whose federal budget for 2003 is predicated on prices of roughly $24 to $25 per barrel. The next day, the Washington Post reported, "The heart of the Internet sustained its largest and most sophisticated attack ever." This claim was only partially true. The classic hacker attack was indeed the largest ever witnessed in 20 years of root history -- in fact, it was the first attack against the roots. But claims that the attack was "sophisticated" were bogus. Most network operators were of the opinion that the attack showed a serious ignorance of the domain name system (DNS) and general network operations. A great deal more damage could have been done if the individuals responsible had targeted the DNS directly. At worst the attack was a test or probe for a potential future attack. The root servers struck by the attack assist computers in translating Internet domain names, such as www.circleid.com, to numeric equivalents used by computers. These servers provide the primary roadmap for 70% of all Internet communications. The remaining 30% of the net now uses competing root service providers who bypass the USG root system. They were not under attack. According to statements by U.S. Federal Bureau of Investigation (FBI) director Robert Mueller, the incident lasted about an hour and originated from computers in the United States and Korea. Most often, computers used in the DDOS assaults are commandeered by hackers either manually or remotely with the help of automated software tools that scan millions of computers for known security holes. These computers often belong to unsuspecting home users. An FBI spokesperson confirmed that the incident was still under investigation. Fortunately, despite its size, the attack had no impact on the Internet, and no users or computers were affected. The USG root server system contains only 258 top-level domains, of which 243 are ccTLDs (country code top-level domains) and the rest are generic top-level domains (gTLDs) like .com, .org and .net. In comparison to many Internet root server systems, the USG is the smallest. As a result of its limited size, most of the information contained in that root is cached by Internet Service Providers (ISPs) and refreshed every 48 hours. Under those circumstances, Internet users would not have noticed the one-hour attack even if all 13 roots had been successfully blocked the entire time. There simply was not enough time for the cache records at ISPs to expire long enough for anyone to notice. Petri Helenius was one of the first people to witness and report the attack in progress. He notified the networking community that the DDOS attack was not "causing any serious operational problems" but was slowing things down. Helenius is a telecommunications expert whose company developed the ROMmon (Robust Online Metric MONitoring) system that alerted Mr. Helenius to the intrusion. Helenius notified the North American Network Operators' Group (NANOG) by email at 21:29 UTC. "I remember spending some time before sending off the email," said Helenius. "And, trying to figure out specifics and failing to get further, I sent the email." The alarms went off at ROMmon at 20:46 (UTC) and the threshold for escalation was crossed at 20:49. The situation dropped "below radar" at 22:01. Helenius pointed out, "the timestamp is a little later than the fact (attack) due to the averaging of the system that (ROMmon) does before it's happy." Paul Vixie, a root operator, confirmed to NANOG that the DDOS attack was an Internet Control Message Protocol (ICMP) request. ICMP messages are used in the processing of datagrams through which Internet systems communicate. This was the first clue to network operators that the people behind the attack had no clue as to how to effectively take out the roots. If the attackers had focused their computer power on generating bogus queries to port 53, used by roots to provide domain name service, the attack might have been successful -- provided that it was sustained for more than one hour. Vixie successfully blocked the DDOS traffic he was getting with the assistance of his backbone providers. This bill will create the Department of Homeland Security, an agency charged with safeguarding Americans and the American way of life. When enacting this bill, we must be careful not stray into invading American's privacy when using the regulatory tools provided for in this bill. I refer specifically to the vague authorizations in this bill that would give this new Federal agency broad authority to push the privacy envelope. Section 201, paragraph 14, charges the Under Secretary for Information Analysis and Infrastructure with the responsibility of establishing a secure communications and information technology infrastructure that specifically authorizes the use of `Data-mining.'' Since ``Data-mining'' has no statutory definition, I am concerned that we have not adequately established that the Department of Homeland Security does not have the green light to adopt an all encompassing program that invades the privacy of every American without their permission or knowledge. We were recently notified that former Rear Admiral John Poindexter is developing a Total Information Awareness program to monitor the everyday transactions of Americans. We cannot allow this to happen. I do not believe that this statutory language is meant to allow the Federal Government to obtain whatever list, public, private, or commercial, to profile Americans. It is clear that the American public does reject this approach, as they soundly voiced their outrage for other privacy-eroding proposals such as the FBI's ``Carnivore'' system, and the Department of Justice ``TIPS'' program. First, Mr. Speaker, I would like to address the privacy concerns that have been raised recently about provisions in the Homeland Security bill. Le me be clear. This bill does not in any way authorize the Department of Defense program knows as ``Total Information Awareness.'' It does not authorize, fund or move into the Department anything like it. In fact, this bill provides unique statutory protections that will ensure the Department of Homeland Security could never undertake such a program. Section 892 of our bill prohibits the sharing of any information that would undermine the statutory and constitutional protections of citizens. We also create a privacy officer, the first ever established by statute, whose sole mission will be to ensure that programs like TIA never get off the ground in this Department. Our bill contains provisions that discontinue two programs that raise the very concerns that TIA has raised. We stop Operation TIPS, and ensure that nobody will use this bill as an excuse to implement a National ID card. So the legislative intent of this bill is unmistakable. This department must protect the civil liberties that we all cherish. I'm trying to remember details (author, title) of a short story that I read once. Its main feature, or the one that's standing out in my mind, is the obsessive hacker who studies a target to figure out his password, at which he only has one guess. The zinger is that the very security concious target has selected that password as a booby trap, and there's a second password which our hacker doesn't have. Does this ring a bell for anyone?
