I am not a lawyer and I can only speak for the German system but judges 
actually consider the intent of a license/contract etc.. I doubt 
its 'worthless' because if you use this 'GPL' code commercially you still 
violate its conditions. They might be wrong in calling their license GPL but 
it is still their written will that you may not use their 'GPL' code in a 
commercial setting. After all, it is their intellectual property we are 
talking about here and they expressed their conditions quite clearly.
