If she had left when originally ordered to, perhaps she could have 
legally attempted to return.  Keep in mind that Obama was a relative 
unknown at this time.  If he knew nothing of her status, why would her 
being kidnapped, if in fact that was even a credible threat, cause any 
issues for him?

Your quote is from one of her attorney's and that hardly lends credence 
to it.
