Oh well - I checked and the drive itself is ineligible for an RMA and obviously I voided the warranty when I opened this up.
i would try explaining the situation to WD and see if they give you an RMA; on a good day they might respect that you wanted to try to get your data and that opening the case had no bearing on the actual failure
