Just because FreeBSD decided to compromise in regards to ZFS, does not mean everyone else has to as well. They could include all sorts of other code with similar licenses, yet there they often stand firm. None of that matters here. As to the rest of what you say about ZFS, I doubt anyone here really cares about ZFS as regards the subject of this list -- OpenBSD.
