I have been calling it "empty layout" for the last 6 years... ;-) I need it both in linuxdoc and in docbook since there the default paragraph is <para> (or related). We have been able to live with this in latex since the default paragraph is empty, this ambiguity allowed us to go this far without much problems... That is why the present logic is wrong, it worked by luck.
