IIRC, M$ are suing for trademark violation. If that is right, then it
does not matter whether Lindows does anything at all or not. M$ are 
simply saying that there is something calling itself an OS whose name
differs from Windows by one letter. M$ are in fact obliged to take
action since otherwise they are at risk of losing their Windows
trademark. 

There was a similar suit recently involving Adobe and Killustrator
(What is it called now? Kontours?).
