I'd say the custom comparator is used but the actual selection done at the
runtime is now completely inline with the spec, some parts of it are
unfortunate, but I had to accept the green 2.0 TCK is a priority. I'll have no
problems adding a property keeping some of your tests green - but note it will
be 2.0 incompatible, though I'm not sure yet what the actual problem is, lets
review it first
