On your first thought -- IANAL, so I can't comment on which way is better or safer. But companies have expensive lawyers for good reasons. So long as they do their job and keep the company whole in the edge cases, I am content.
On your second thought -- Of course I am, or I wouldn't have said so. That happens to be a not-always-small part of my regular day job, thank you very much, so yes I am "equipped and willing". And there are a few more of us still around. Now whether the COMPANY thinks it is "equipped and willing" in the worst-case scanrio is a different kettle of fish entirely, and way above my pay grade. If very prompt defect repair is an important issue, write effective SLA's with increasing financial penalties for delayed defect repair into the contract as well. We have had quite good luck with a few very helpful software products and very responsive authors.
