Have your lawyers verify that the escrowed source code can't be treated as an asset during bankruptcy.

If very prompt defect repair is an important issue, write effective SLA's with increasing financial penalties for delayed defect repair into the contract as well. We have had quite good luck with a few very helpful software products and very responsive authors. Worst case, your company has the rights to the source code and can continue to support it yourself until transitioning to another product with active support. I haven't tried their software yet. Here's their claim: Z-Writer is the quick-code utility for z/OS mainframes. Its native syntax is very similar to competing quick-code tools such as DYL-280, Easytrieve, Quikjob and CA-Earl. If you are using one of those programs, you'll be able to run your existing programs on Z-Writer with only minor changes. And with our ZWDYL interface, you can actually run all your existing DYL-280 (VISION:Results) program without any changes to either the program code or the JCL. Our ZWQUIK interface (beta) lets you do the same thing for your Quikjob (VISION:Report) programs. The company is called Pacific Systems Group and their website is https://urldefense.com/v3/__https://urldefense.us/v3/__https:/*urldefense.com/v3/__http:/*www.pacsys.com__;!!IfVdvpvC!CRxRrdvGWX-0nF0bVEqPXCKpp-epQtvKj6gCX4cYLqYFJPS6BQu-VN7SsHFfHy0Q$__;Lw!!JRQnnSFuzw7wjAKq6ti6!lIkp7xHfxb1h6PPHaMRI9y3NkCXL44B7OHGt-ZGA2sPa1ZQbvTCFOYFQ0W7WRQ$__;Lyo!!Ebr-cpPeAnfNniQ8HSAI-g_K5b7VKg!bYUihWs1OKKIn7Dbxr3lju5Q6LdGkrokLRK53cGOmJwM7ZCjihz4aFSBCPynqT440jqYnw$ . Let me know if you check it out and how they work for you. I will say I checked pricing and at least at this point in time for us, their price isn't much less than the CA products we're looking to replace.
