hercules isn't actually an "emulator".

It is an implementation of the z/Architecture (amongst other thing).

Just (one of several) implementations of a documented interface.

Even if the designer of the interface specification and the implementer are the same, it still doesn't make it right.

And if this is the case - and it is confirmed on a brand new machine, I'm pretty sure it will get fixed eventually.
