You have lost me here. Are you saying that the supposed license
contradicts the patent grants in the Apache license, which are
explicitly mentioned by the required notices?
Has this ever happened, or are we in hypothetical-land?
Alan asked a what-if question, so we are safely within
hypothetical-land. Based on some stuff that I read on
legal-discuss (but won't bother to look up now), I believe
that the FSF believes that GPL 2.0 is incompatible
with AL 2.0, while some ASFers believe that the FSF is
in error on this point.
