I see the smiley, but I'd say the serious answer to that is that it might or might not be depending on what we knew about the copyright status of that code. If we knew (and this is the hard part!) through some means OTHER than the copyright notice in the files themselves that distributing these test case would not violate the copyright on them, then I think it would be fine to include them whether or not they were assigned to the FSF or whether the license was the GPL or not.
