It’s not always so clear who owns copyright. That's one reason Apache has ICLAs. But you're right in that in the US it is generally the case that the company you work for owns the copyright of all code you produce. But if I had written that code in Australia, by default the company I wrote it for would not own the copyright and would of needed my permission to change the license.
