I would only add one sentence to the end of part two.  It says:

  (2) The distributor can give the user an offer to provide the source
      to anyone (not merely your own customers) at a later
      date. Pointing to a third party (e.g. another company that sells
      source CDs) is not sufficient.

I would add

  You may charge a fee for providing the source, but only for what it
  costs you to do so.

This may eliminate some disributors fears about having to do unlimited
distribution at their own expense.
