You are correct, I was deceived by the fact that there are two variants of the 3-claused license specified in there: one is using stanza 1., 2., and 3., while the majority from Berkeley is expressing 1., 2., and 4. They are functionally equivalent, but presumably I will have to decide how to include both of them into the collection made mandatory by DEP-5.
