Under the principles of equity, that shouldn't matter.  Given that the
time limit actually did expire, there is a case at equity.  Dismissing
the CFJ (actually, imposing the null judgement) and making pikhq refile,
on grounds of eir marginal prematurity, would be procedurally justified
but would not make the situation any more equitable, so would be a
poor decision.
