The first thing is that you shouldn't use that patch - it's an old version and 
it has many known bugs. The official location for up-to-date SKAS patches is

This is surely a version mismatch, yes.

Try to use the appropriate patch from my homepage (likely not the one for 
2.6.7, I've had to release an updated patch for almost every 2.6 release), 
but there's no guarantee they'll apply on a distributor kernel (as opposed to 
kernel.org kernels).

Moreover, the current stable version of the patch is V8.2 (all other ones have 
known bugs), and the earliest kernel it supports is 2.6.11.
