Problem is that the .40 driver was a security update. That means that downgrading the Ubuntu version to their .33 would expose all nvidia users to the (now public) security bug. IOW delivering .33 to you in the Ubuntu LTS would be irresponsible of us. NVIDIA is aware of the issues and working on fixes. Remember we have -updates now, that we can roll out fixed drivers to for those of you affected by this.
