I am using vanilla kernel (2.6.31.1), not from ubuntu. I was searching net when I came across this thread. Nevertheless you can download kernel source from ubuntu and check manually whether they have used it or not. This patch basically disables power save and rfkill feature in ath9k. It will comment powersave options in config file and comment one function in ath9k. You can manually look at patch and use it.
