This is not a question if we "feel" that you can remove this note. These are legal terms, and _you_ must verify if you are permitted to change the licensing terms in any way. I am not a lawyer, but in the curent case you probably have to check with Marvell's legal department if they give permission to re-license this code under GPLv2 and later.
